The agreement
Ikiform is provided by Preet Suthar, an individual based in India ("Ikiform", "we", "us"). By creating an account or using Ikiform, you agree to these terms. If you use Ikiform for a company, you agree for that company and confirm you're allowed to.
Our Privacy Policy and Refund Policy are part of these terms, as are the Data Processing Agreement and the Acceptable Use Policy.
The service
Ikiform receives form submissions from your websites and apps, checks them for spam, stores them in your workspace, sends notification emails and delivers them to your endpoints as signed webhooks. You build and host the form. Ikiform runs the backend.
Ikiform doesn't review your forms before they go live and has no duty to monitor them. You're responsible for your forms, what they ask for and what you do with submissions.
We improve Ikiform all the time, so features can change. We won't remove a core feature you pay for without telling you first.
Your account
- You must be at least 18, able to make a binding contract, and give us a real email address.
- Keep your sign-in and API keys safe. You're responsible for what happens in your workspaces, including what your teammates and API keys do.
- Tell us right away if you think someone got into your account.
Plans and payment
Ikiform has one paid plan, Pro, in 9 sizes from $6 a month for 500 submissions up to $399 a month for 1M submissions. There is no free plan. Current prices are on the pricing page. Enterprise is priced by agreement.
- You can pay monthly or yearly. Yearly costs the same as 10 months.
- Prices are in US dollars, before tax.
- Dodo Payments is our merchant of record. It sells Ikiform to you, takes the payment, charges any sales tax or VAT and issues invoices. Dodo's own terms also apply to the purchase.
- Your plan renews automatically at the end of each month or year until you cancel.
- Your plan starts as soon as the payment goes through. At checkout you ask us to start right away. If the law where you live gives you a right to cancel, see Where local law gives you more in the Refund Policy.
- If we change prices, we'll email you at least 30 days before the change reaches your next renewal.
Submission limits
Each size includes a number of submissions a month. A submission is one form post that passes validation and spam checks. Blocked spam and invalid posts don't count. Usage resets at 00:00 UTC on the 1st of each calendar month.
- We email you at 80% of your limit and again when you reach it.
- Above your limit, new submissions are held. Visitors still see a normal success page, but held submissions stay hidden and send no webhooks or emails until you move up a size. Then they're all released. Held submissions are deleted after 30 days.
- At 2× your limit, new submissions are turned away until next month.
- We never charge you for going over.
Changing or cancelling
- Moving up a size applies as soon as the payment goes through. You pay the difference for the rest of the current period.
- Moving down applies at your next billing date. You keep the bigger limit until then.
- You can cancel anytime from the billing portal. Your plan keeps working until the end of the period you paid for, then it ends.
- If a renewal payment fails, your forms keep working for 7 days while you fix it. After that, new submissions are held until you pay.
- Without a plan, your forms stop accepting submissions. You can still sign in and export your data.
Payments are non-refundable, except for billing mistakes, if we close your account without cause, and where the law where you live gives you more. The Refund Policy has the details, including the rights some countries give consumers.
Your data and your visitors
Your forms, submissions and settings are yours. You give us permission to store, process and send them only as needed to run Ikiform for you.
Submissions contain your visitors' personal data. For that data you are the controller and Ikiform is your processor. That means you:
- Need a lawful reason to collect what your forms ask for.
- Tell your visitors, in your own privacy policy, that you use Ikiform to receive their submissions.
- Handle their requests to see or delete their data. You can delete submissions in the dashboard or through the API.
Our Data Processing Agreement applies to that data automatically when you use Ikiform. It is part of these terms.
Acceptable use
You must follow our Acceptable Use Policy. In short: no phishing or collecting passwords, no spam, no malware, no illegal content, and no payment card numbers or health information covered by HIPAA in your forms. Government ID numbers, other health data and other sensitive data need our written agreement first.
If you or your forms break that policy, we may hold notifications, pause or disable forms, or suspend or close your account, as the policy describes.
How we handle reports
Anyone can report a form to abuse@ikiform.com. We review reports by hand. When we act on a form or account, we tell the workspace owners what we did and why, unless the law or a risk to people stops us, and they can ask a person to review the decision. Details are on our Abuse and takedown page.
Spam checks and webhooks
Spam checks, Turnstile and rate limits stop most bots, but no filter is perfect. Some spam may get through, and now and then a real submission may be marked as spam. Check your spam folder in the dashboard.
Webhooks are retried with backoff when your endpoint fails, then moved to a dead-letter queue. You're responsible for your endpoints, including verifying signatures and keeping them online.
Ikiform isn't a backup. Keep your own copy of submissions you can't afford to lose, by exporting them or sending them to your own systems with webhooks.
Availability
We work hard to keep Ikiform fast and online, but we don't promise it will never be down or slow. Pro has no uptime guarantee. Enterprise may have one by written agreement.
Ending the agreement
You can stop using Ikiform, cancel your plan or delete your account at any time.
Suspension
We may suspend all or part of your account right away when it's reasonably needed to stop harm to people, to Ikiform or to other customers, to stop a breach of these terms or the Acceptable Use Policy, or because the law requires it. We'll limit the suspension to what's needed, tell you why where we're allowed to, and lift it once the problem is fixed.
For unpaid renewals, your forms keep working for the grace period described above. After that, new submissions are held until you pay. We won't close an account only for non-payment without emailing you first.
Closing an account
We may close your account if you seriously or repeatedly break these terms, or don't fix a breach within 14 days of our email asking you to. We may also stop offering Ikiform altogether, with at least 60 days' notice.
Your data when an account ends
- If you delete a form, workspace or your account yourself, it is deleted as the Privacy Policy describes, usually within minutes and always within 24 hours.
- If your plan ends or isn't renewed, your forms stop accepting submissions but your data stays, and you can still sign in and export it. We'll email you at least 30 days before we delete data from a workspace without a plan.
- If we close your account, or stop offering Ikiform, you'll have 30 days to export your data, unless the data itself is illegal or the law stops us. Then we delete it.
Disclaimers
Ikiform is provided "as is" and "as available". As far as the law allows, we make no other promises, including that it fits a particular purpose or will be free of errors.
Limits on liability
As far as the law allows, we aren't liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for all claims together is limited to the greater of what you paid Ikiform in the 12 months before the event that caused the claim, or US$100.
These limits don't apply to what you owe us for your plan, to your responsibility under the next section, or to a breach of the Acceptable Use Policy.
Nothing in these terms limits liability that can't be limited by law, or takes away rights you have under consumer law that can't be excluded, such as the guarantees under the Australian Consumer Law.
If you're in New Zealand and use Ikiform for a business, you agree that the Consumer Guarantees Act 1993 doesn't apply, as section 43 of that Act allows.
Your responsibility
You'll defend Ikiform against, and pay the costs, damages and reasonable legal fees that come from, any claim by someone else that arises from: the content of your forms or the data you collect with them; how you use submissions; your breach of these terms or the Acceptable Use Policy; or your breach of the law or of someone else's rights.
We'll tell you about the claim promptly, let you control the defence, and help where reasonable. You can't settle a claim in a way that admits fault for us or makes us pay without our agreement.
Governing law
These terms are governed by the laws of India. Disputes go to the courts of India, unless your local consumer law gives you the right to use your own courts.
Changes to these terms
We may update these terms. We'll change the date at the top, and email account owners at least 30 days before a significant change takes effect. If you don't agree, you can cancel before it takes effect. If you keep using Ikiform after that, the new terms apply.
General
- Force majeure: we aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at Cloudflare or other providers, internet failures, natural disasters, war or government action.
- Transfer: you can't transfer these terms to someone else without our agreement. We can transfer them to a business that takes over Ikiform, and we'll tell you if we do.
- Severability: if a court finds part of these terms unenforceable, the rest still applies.
- No waiver: if we don't enforce a term right away, we can still enforce it later.
- Whole agreement: these terms, and the policies they link to, are the whole agreement between us about Ikiform. A signed Enterprise agreement wins where it differs.
- Notices: we send notices to the email addresses of your workspace owners. You send notices to hello@ikiform.com.
- Survival: the sections on payments owed, your data, disclaimers, limits on liability, your responsibility and governing law keep applying after the agreement ends.
- Feedback: if you send us ideas or feedback, we can use them without owing you anything.
- Other services: sign-in with Google or GitHub, Cloudflare Turnstile and Dodo Payments are run by other companies under their own terms.
- Sanctions: you can't use Ikiform if Indian, US, UK or EU sanctions law forbids us or our payment provider from dealing with you or your country.
